CITY OF GLENDALE EVENT APPLICATION AND RELEASE

Please accept my application for the City of Glendale's GLENDALE FAMILY BICYLE RIDE (hereinafter “Event”). I ACKNOWLEDGE THAT BY SIGNING THIS DOCUMENT I AM RELEASING THE CITY OF GLENDALE, ITS EMPLOYEES, ELECTED OFFICIALS, AGENTS, SPONSORS, PROMOTERS OR AFFILIATES (hereinafter “Sponsors”) FROM LIABILITY CONNECTED WITH THIS EVENT. I UNDERSTAND THAT THIS APPLICATION AND RELEASE IS A CONTRACT WITH LEGAL CONSEQUENCES.

In consideration of the Sponsor's acceptance of my application for the Event, I hereby understand and agree or assert:

That cycling can be a dangerous sport and that I fully assume the risks, including, but not limited to: collision with pedestrians, other participants, vehicles or fixed or moving objects; surface hazards or weather conditions; the risk of serious physical injury or otherwise; and that I have no physical or medical condition, which to my knowledge, would interfere with my ability to participate or would endanger myself or others.

That it is my responsibility to be familiar with the Sponsor's rules, and any special regulations for the Event; that situations may arise that may be beyond the control of Event officials and that my continued participation in the Event must neither endanger myself nor others; and that I will wear a helmet during the Event and accept responsibility for the condition and adequacy of all my equipment, including the helmet.

That for my myself, heirs, executors, administrators, legal representatives, assignees and successors in interest, (collectively herein “Successors”) I hereby waive, release, discharge, hold harmless and promise not to sue the Sponsors and agree that I will indemnify the Sponsors from any and all claims, including claims arising from my own negligence, resulting from my participation in the Event.

I further agree for myself and my Successors that the above representations are contractually binding and that if I or any Successor asserts any claim in contravention of this release, the party asserting the claim shall be liable for all expenses, including legal fees, incurred in defending the claim unless the Sponsor is finally adjudged liable on the claim for willful and wanton negligence; that this release may not be modified orally, and waiver of any provision herein shall not be construed as a modification of any other provision; that every provision of this release is intended to be severable and if any other provision is found to be unenforceable that the remaining provisions shall remain binding and enforceable.
