Ordinance Banning the Use
of Motorized Skateboards on Public Property

AN ORDINANCE OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA, AMENDING GLENDALE CITY CODE, CHAPTER 8, BANNING THE USE OF MOTORIZED SKATEBOARDS ON PUBLIC PROPERTY AND RIGHT-OF-WAY; PROVIDING PENALTIES FOR VIOLATION; AND ESTABLISHING AN EFFECTIVE DATE.

WHEREAS, the State of Arizona has granted municipalities express authority to regulate or prohibit the operation of motorized skateboards; and

WHEREAS, the City Council has received public input generally in favor of a complete ban of motorized skateboards from public streets; and

WHEREAS, the City Council finds it is in the best interest of the City of Glendale and the citizens thereof to prohibit the operation of motorized skateboards except on private property.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GLENDALE as follows:

SECTION 1. That Glendale City Code, Chapter 8, Article I is hereby deleted in its entirety (consisting of Secs. 8-51 through 8-58) and replacing it with a new Article I to read as follows:

ARTICLE I. MOTORIZED SKATEBOARDS

Sec. 8-51. Definition.

The following word, term and phrase, when used in this article, shall have the following meaning ascribed to it, except where the context clearly indicates a different meaning. Whenever any words or phrases used in this article are not defined but are defined in the Motor Vehicle Laws of Arizona (Arizona Revised Statutes, Title 28, Chapters 3, 4 and 5 (A.R.S. §§28-601, et seq., 28-1301, et seq., and 28-1501, et seq.) and supplements thereto), such definitions shall apply.

Motorized skateboard: A self-propelled device that has a motor, gas or electric, a deck on which a person may ride and at least two tandem wheels in contact with the ground and which is not otherwise defined in A.R.S. §28-101, et seq. as a motor vehicle, motorcycle, motor-driven cycle, motorized wheelchair or electric personal assistive mobility device.

Sec. 8-52. Banning motorized skateboards; additional prohibitions; penalty.

(a) It is unlawful for any person to operate a motorized skateboard in any city park, on any public sidewalk, roadway, or any other part of a street or city property.

(b) It is unlawful for any parent, guardian or legal custodian of any minor to authorize or knowingly permit such minor to violate any of the provisions of this article.

(c) A violation of this article shall result in a fine of not more than one hundred fifty dollars ($150.00).

SECTION 2. That the provisions of this ordinance shall become effective thirty (30) days after passage of this ordinance by the Glendale City Council.
